SC upholds bail to Minni

FE Report | September 03, 2019 00:00:00

The Appellate Division of the Supreme Court (SC) on Monday upheld a High Court (HC) order granting bail to Aysha Siddika Minni, who was arrested in a case filed over the murder of her husband Rifat Sharif in Barguna.

Chamber judge of the Appellate Division Justice Hasan Foez Siddique passed "no order" on a government petition seeking a stay on the HC order.

Now, there is no legal bar for Minni to get released from the jail following the SC order, said Advocate ZI Khan Panna, a lawyer for Minni.

"We hope Minni will get released from Barguna jail within a day or two after formal process," he added.

In the hearing, Advocate Panna appeared for Minni while Attorney General Mahbubey Alam and Deputy Attorney General KM Jahid Sarwar Kazal stood for the state.

On August 29, the High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman granted bail to Minni in the case on conditions that she will remain in her father's custody and she will not talk to the media, otherwise her bail will be cancelled.

Earlier, a Barguna court had rejected Minni's bail petition twice -- on July 22 and 30.

After being rejected in the trial court, Minni filed the bail petition with the HC through her lawyers on August 5.

Police arrested Minni on July 16 after a daylong interrogation and produced her in the court for the remand the following day. No lawyer represented Minni during the remand hearing in the court.

On June 26, Rifat Sharif, a 25-year-old Internet service provider, was indiscriminately hacked to death by a group of youths in Barguna.

In a video footage of the incident that went viral in the social media, Minni was seen screaming and trying in vain to save her husband from the assailants.

The victim's father filed a murder case with Barguna Sadar Police Station against 12 people the same day.
