Legal notice served on government

A legal notice has been issued on Wednesday upon the government to take action against former civil aviation and tourism minister Rashed Khan Menon and two others for their involvement with casino gambling in the country.

Two other persons are Md Shamsul Huq Chwodhury, whip of the national parliament and Md Muhibul Haque, secretary of the Ministry of Civil Aviation and Tourism.

Advocate Md Eunus Ali Akond, a Supreme Court lawyer, served the notice yesterday and requested them to reply within 24 hours. If they fail to reply within the stipulated time, a writ petition will be filed with the High Court against the notice receivers.

A copy of the notice has also been served to the secretary of the Ministry of Home Affairs to take necessary actions against all those are involved with the casino gambling in the country and another copy has been served to the State Minister of Civil Aviation and Tourism Md Mahbub Ali for his presence in a meeting which took decision on casino.

It was said in the legal notice, "The Article 18(2) of the Constitution of Bangladesh provides that 'The State shall adopt effective measures to prevent prostitution and gambling."

"Gambling/casino is a criminal punishable offence as defined under section 3, 4, 13 of the public gambling act, 1867. Anything made punishable by this act shall be deemed to be as 'offence' within meaning of the penal code," reads the notice.

"Rashed Khan Menon, MP of Dhaka-8 constituency who is chairman of the governing body of the Youngman's Club Fakiraful, inaugurated the casino with cutting red rope. His photograph has also been seen at his room of Youngman's Club. The law enforcers didn't take any action against the said chairman though some others were arrested. The said member of parliament is liable for joint crime as defined under section 3, 4, 15 of the public gambling act," reads the notice.

"Secretary of the Ministry of Civil Aviation and Tourism Md Muhibul Haque took a decision on September 24, 2019, in presence of State Minister of Civil Aviation and Tourism Md Mahbub Ali that they will set casino for foreigners. But the decision is also unconstitutional as above," also reads the notice.
