SC upholds HC verdict scrapping five cases against Prof Yunus

The Appellate Division of the Supreme Court on Sunday upheld a High Court verdict that scrapped the proceedings of five cases filed under the Bangladesh Labour Act against Chief Adviser Professor Dr Muhammad Yunus and others.

A three-member bench of the Appellate Division headed by Justice Md Ashfaqul Islam passed the order after dismissing a leave to appeal petition filed by the state against the High Court order.

Barrister Mustafizur Rahman Khan appeared in the court hearing on behalf of Prof Yunus while Additional Attorney General Barrister Aneeq R Haque represented the state.

Earlier on October 24 this year, a High Court bench scrapped the proceedings of six cases, including five filed under the Bangladesh Labour Act, against Prof Yunus and others.

The High Court bench of Justice AKM Asaduzzaman and Justice Syed Enayet Hossain delivered the verdict after hearing separate petitions filed seeking to scrap the cases.

Later the state filed a leave to appeal petition against the High Court verdict scrapping the proceedings of the five cases filed under the Bangladesh Labour Act. After hearing on the leave to appeal petition, the apex court passed order on Sunday.

Md Emranul Haque, a former employee of 'Grameen Communications', an entity owned by Prof Yunus, and four others filed five cases with the 3rd Labour Court in Dhaka.

Md Emranul Haque decided to form a trade union upon discussion with his co-workers and on April 16 in 2019 applied for the registration of the union, "Grameen Communications Sramik Karmachari Union". However, the application was rejected by the Director General.

The authorities of the Grameen Communications being angered by such union activities of the complainant issued a letter on June 18 in 2019 with immediate effect informing the complainant that the term of his contractual employment was not renewed.

The complainant then informed it to the Director General of the Department of Labour by a complaint on June 23 in 2019.

Later the 3rd Labour Court in Dhaka took cognizance of the case and issued summon against the officials of the Grameen Communications. Four other cases were filed with the court following the same way.
