10 dropouts appointed as regular HC judges

President M Zillur Rahman appointed ten dropouts as regular judges to the High Court (HC) as they won legal battles against 29 incumbents, said a senior law ministry official Tuesday, reports UNB.
The official, requesting anonymity, told the news agency that the President made the appointments in compliance with the recent Supreme Court (SC) judgment.
"A gazette notification in this regard will be published tomorrow (Wednesday)," the official said, adding that the appointments would come into effect from their swearing in as judges.
The appointees, who came from among practicing lawyers and judicial service officers, are M Abdus Salam, Momtazuddin Ahmed, M Shamsul Huda Manik, Faruque Ahmed, Hassan Faiz Siddiqui, M Abdul Hye, M Abdur Razzaq, M Marzi-ul Huq, Nizamul Huq Nasim and AHM Shamsuddin Chowdhury Manik.
On March 2, the Supreme Court affirmed partly the High Court judgment asking government to reinstate ten confirmation-denied additional judges as regular HC judges, sans seniority, from the date of non-confirmation.
Passing a short order with a five-point guideline to consider the cases of the ten dropout judges, a five-judge Appellate Division headed by Chief Justice MM Ruhul Amin had disposed of the leave-to-appeal petitions filed by 29 sitting litigant HC judges.
On July 17 last year, the High Court, upon writ petitions of the ten dropouts, including a public interest litigation (PIL), filed in 2003, ordered the government to reinstate them as regular HC judges ensuring their seniority.
The HC ruling had also declared unlawful and unconstitutional Presidential action of non-confirmation despite recommendations by the Chief Justice.
