CJ appointment president's jurisdiction: HC

Wednesday, 27 October 2010

The High Court has disposed of a petition filed seeking appointment of the chief justice (CJ) based on seniority, saying that the issue is exclusively under the president's authority, reports bdnews24.com.
The court order said that the president can assign anyone as the chief justice who he deems eligible.
The bench of justices Mohammad Imaan Ali and Obaidul Hasan gave the order Tuesday.
The verdict says, "No section in the constitution allows appointment of the chief justice based on judges' seniority. The president, corresponding to the constitution, is accountable to none while appointing anyone other than the most senior Supreme Court judge."
The president, however, can take advice from anyone he wants to, the verdict adds.
The Petitioner Hasan MS Azim told reporters that they will go to the Appellate Division against the High Court order.
