Commerce Bank Chair, MD, Secy summoned
FE Report | Wednesday, 22 October 2014
The High Court (HC) summoned Tuesday Bangladesh Commerce Bank Limited's chairman, its managing director and company secretary to explain about a contempt of court allegation, court sources said.
They will have to appear before the HC on November 10.
The HC bench comprising Justice Md. Rezaul Hasan also issued a rule upon a contempt of court petition filed for not complying with its earlier order.
Court sources said that a shareholder of the bank filed a case with the HC challenging the nomination, instead of election of, an individual as its director.
After hearing on the matter, the HC on March 3 this year passed a direction to elect directors. In line with the order, an individual - Md Zakir Hossain-was elected as director by the shareholders' votes at the bank's 14th Annual General Meeting (AGM).
He attended two meetings of the bank. Then, following another shareholder's petition, the HC imposed injunction on his attendance in meeting for six weeks, which expired on June 23.
However, after expiry of the injunction, Mr Zakir was not served with notice of next meetings, his lawyer said.
Thereafter, the court directed the bank authorities on September 9 to serve notices of all the meetings concerned to Mr Zakir as elected director. At the same time, the court ordered to submit a compliance report before it on September 14
For 'not complying' with the order, the HC Tuesday issued the summon following his contempt of court petition.
Barrister Omar Farouq appeared for the petitioner in the court.
