28-storey building at Banani

Fix possessions in a month: HC

FE REPORT | Wednesday, 30 August 2023

The High Court has directed Dhaka North City Corporation (DNCC) and Borak Real Estate Ltd to settle in a month their possessions and shares of a 28-storey building constructed on DNCC land at Banani.
Borak built the structure in accordance with the principle of equity of law and agreement.
Both parties have been asked to submit reports after complying with the directive before the HC.
The court also fixed October 09 for further hearing and passing order on this issue.
The HC bench of Justice Md Nazrul Islam Talukder and Justice Khizir Hayat passed the order during the hearing of a rule issued over this matter on Tuesday.
Following a writ on June 11, the bench asked both parties the next day to reach an amicable settlement over the possessions and shares of the building.
It also asked the respondents as to why they should not be directed to receive their possessions and shares as agreed, said Abu Taleb, a lawyer for Borak.
Senior lawyer ABM Altaf Hossain appeared for Borak while barrister Imtiaz Moinul Islam stood for DNCC and deputy attorney general Saifuddin Khaled represented the state during the hearing.
Barrister Syed Sayedul Haque Suman submitted the writ as public-interest litigation to the HC, seeking its directive to investigate reported corruption in signing a contract between Borak Real Estate and the DNCC for building the multi-storey complex.
He made the move after a report was published in a Bangla daily on June 01 headlined 'Sorkari jamite panch taroka hotel' (Five-star hotel on government land).
