Govt plans compulsory provision for alternative dispute resolution

Thursday, 17 September 2009

The government plans for mandatory introduction of alternative dispute resolution (ADR) for both civil and certain criminal cases to free courts from huge backlog of cases and to protect "social amity".
"The optional provision of the alternative dispute resolution is already there in our Civil Procedure Code and we now want to make the system compulsory for both the civil and certain criminal cases engaging mediators," Law Minister Shafique Ahmed told BSS.
He said a proposal seeking to introduce the system, was referred to the Law Commission, which was expected to come up with a draft law soon for subsequent enactment.
Ahmed said the courts at different levels including the Supreme Court were burdened with thousands of cases while the situation frustrated the very spirit of quick disposal of justice.
