Govt plans to appeal against HC ruling

The government plans to move an application before the chamber judge of the Appellate Division for halting operation of the High Court (HC) ruling for reshuffling bigwigs' positions in the Warrant of Precedence, as it prefers leave to appeal, reports UNB.

"I'm waiting for the official instruction in this regard," Advocate SM Rezaul Karim, specially engaged counsel for the establishment ministry, told the news agency Saturday.
The lawyer said that the government would go for appeal against the HC ruling that has declared illegal the existing Warrant of Precedence and asked for framing a new one downgrading military chiefs of the three services.
If the HC edicts are implemented, district judges will take precedence over the army, navy and air-force chiefs in the state hierarchy and government secretaries are to take seat after them at state functions and ceremonial occasions.
On Thursday, the HC, upon a Public Interest Litigation writ petition filed by a district judge, declared illegal the revised Warrant of Precedence (WoP) and ordered reshuffling the state hierarchy with constitutional post-holders and district judges placed above the military chiefs and the top government bureaucrats.
