HC declares Falu's detention illegal

Friday, 19 December 2008

The High Court (HC) Thursday declared illegal the detention of former BNP MP Mosaddek Ali Falu, reports UNB.
Delivering the verdict upon a habeas corpus petition challenging the detention under the Special Powers Act, a division bench, comprising Justice Mir Hasmat Ali and Justice Shamim Hasnain, asked the government to release Falu if he was not wanted by the police in any other criminal cases.
On October 29, the government had issued a detention order against Falu just before his release from jail on bail following a general diary filed by a Special Superintendent of the Special Branch (SB).
According to the SB report, the law and order situation might deteriorate if Falu was released.
On February 5 last year, joint forces arrested Falu, also political secretary to ex-Prime Minister Khaleda Zia, from his city residence on charges of corruption.
Meanwhile, another HC division bench granted bail for two months to Falu in a case relating to embezzlement of CI sheets allotted for relief.
Emerging from the court, Ahsanul Karim, a counsel for Falu, told journalists that there was no legal bar to his client's release from jail as he had already secured bail from all other criminal cases filed against him.
