HC declares illegal 10 addl judges' non-confirmation

Friday, 18 July 2008

The High Court (HC) Thursday declared unlawful and unconstitutional the President's action of non-confirmation of 10 additional judges as regular Justices of the HC despite recommendations made by the Chief Justice, reports UNB.

The 10 judges are Abdus Salam and Momtazuddin Ahmed appointed on October 24, 2001, M Abdul Hye, Faruque Ahmed, M Marzi-ul Huq, M Shamsul Huda Manik, M Abdur Razzaque and Hassan Faiz Siddiqui appointed on February 22, 2003, and AHM Shamsuddin Chowdhury and Nizamul Huq Nasim appointed on July 27, 2003.

They came from among practising lawyers and judicial service officers.

As they were appointed during the Awami League rule, the judges were not made regular after the BNP-led four-party alliance government came to power, even though they successfully completed their two-year judicial functions, a precondition to become a regular Justice.
