HC rebukes OC, ASI for arresting student on bail

FE REPORT | Tuesday, 25 July 2023

The High Court on Monday rebuked Patuakhali Sadar Police Station Officer-in-Charge (OC) Md Moniruzzaman and Assistant Sub-Inspector (ASI) Mizanur Rahman in connection with the arrest of college student Md Ashraful Hawlader, who was on anticipatory bail in a case.
They had to face the situation while appearing in the High Court bench of Justice Mustafa Zaman Islam and Justice Md Aminul Islam. Two policemen appeared in the HC bench for three days over the incident. Their lawyer further sought unconditional apology on their behalf.
At that time, the court addressed the two policemen and said, "Have you become the owner? You (indicating the OC) hang up the phone call saying you are in a meeting. You did not call back after the meeting and even did not take any action. The people are the owner of the country. But wherever one sits, he becomes the owner of that place."
"Do you consider yourselves as the owner? You arrested one accused and sent him to court despite he was on bail. Did the country become independent for this? You also have the responsibility to protect the dignity of the court," said the court.
After the hearing, the court fixed July 30 to pass order regarding the issue.
Recently, a newspaper published a report under the banner of 'student on-bail arrested, later released by court', over an incident. Ali Ahsan Molla, a lawyer of the victim, drew the court's attention to the report.
Considering the issue the High Court bench on May 21 issued a rule on a Suo Motu move (on its own motion). At the same time, the court summoned the two officials to appear before the court on June 18 to explain over the arrest.
