HC throws out Happy\\\'s plea for Rubel\\\'s expulsion from WC squad

The High Court (HC) has thrown out a petition of actress Naznin Akter Happy seeking expulsion of cricketer Rubel Hossain from Bangladesh's World Cup squad, reportsĀ  bdnews24.com.
Tuesday's orders came after Happy's lawyer Md Yunus Ali Akhand failed to appear before the court thrice, defence counsel Moniruzzaman Asad said.
The judges called Akhand for hearing thrice - at noon, around 2:30 pm and 4:00 pm - but he did not appear, prompting the dismissal.
Akhand later said they would appeal to revive the petition.
Actress Happy made headlines after she had sued Rubel accusing him of backing off from promised marriage after nine months of intimate relationship.
Rubel, currently on an anticipatory bail, has been drafted in the 15-man World Cup squad.
Happy sought court orders for confiscation of the pacer's passport until settlement of the case.
The petition seeks another rule as to why police would not be ordered to provide security to 'keep Happy safe from Rubel'.
Secretaries to home, sports, the Bangladesh Cricket Board president, Dhaka's chief metropolitan magistrate, Rubel, Women and Children Repression Prevention Tribunal-5 and the Mirpur Police Station's OC have been named defendants in the writ petition.
Happy filed a case against Rubel with Mirpur police on Dec 13. She underwent medical test the next day at the Dhaka Medical College and Hospital.
The test result suggested that Rubel did not force her to sleep with him.
She alleged Rubel got involved with another girl while their marriage was being negotiated.
She lodged the complaint when he allegedly started avoiding her.
Happy, who studies BBA at a private university, acted in a recent Bengali film and more films starring her are in the pipeline.
Rubel secured the one-month anticipatory bail from the High Court two days after the case was filed.
He rejected Happy's allegations and accused the actress of 'blackmailing'.
A Dhaka court ordered a DNA test of Rubel on Dec 31 following an appeal by Mirpur Police Sub-Inspector Md Masud Parvez.
