Justice Nayeem resigns

Appellate Division judge of the Supreme Court Shah Abu Nayeem Mominur Rahman resigned Thursday, apparently protesting the appointment of the Chief Justice superseding him, reports UNB.
The resignation of Justice Nayeem was confirmed by the Registrar of the Supreme Court.
Nayeem, the senior-most Judge was twice superseded while appointing the Chief Justice. He sent his letter of resignation to the President under Article 96(8) of the Constitution. It says: "A judge may resign his office by writing under his hand addressed to the President."
Noted lawyer Rafique-ul Huq met with Justice Nayeem at his chamber Thursday. Later he told reporters that Justice Nayeem resigned as he was superseded twice in appointing the Chief Justice. "Any dignified person will stand down under the situation."
Aggrieved Justice Nayeem quit his office six months ahead of his retirement due on November 14 this year.
The President on Wednesday appointed Justice M Muzammel Hossain, who replaces ABM Khairul Haque who will retire on May 17.
