Khaleda to get back house if she wins legal battle: AG

Monday, 15 November 2010

Attorney General Mahbubey Alam has viewed that there was no legal bar for the government to execute the High Court verdict in evicting BNP chairperson Khaleda Zia from her Dhaka Cantonment house on Saturday, reports UNB.
Briefing newsmen Sunday he said the government acted in compliance with the court order. Khaleda's counsel did not move the petition for stay on operation of the High Court verdict. They only sought for deferment of hearing on the application for leave to appeal before the Appellate Division on November 11.
He pulled up the counsel for Khaleda for failure to secure relief for her. He also questioned the wisdom of her counsel for not moving the petition seeking stay of operation of the High Court order.
They were fully aware that there was no stay on the operation of the High Court verdict over vacating the house.
"Now they (Khaleda's lawyers) are making false propaganda with malafide intention and giving wrong interpretations of law and legal convention resulting in confusion in public minds over the issue," he said.
Refuting the argument of the counsel for Khaleda, Attorney General said the stay does not automatically come into effect on mere submission of stay petition.
The auto-stay only comes into effect during filing the appeal against any condemned accused, he made it clear
