RPO clause on fresh retirees to run for polls stands: HC

FE REPORT | Tuesday, 5 December 2023

The High Court (HC) has declared valid a provision of the Representation of the People Order (RPO) 1972 related to a retired government service-holder's participation in parliamentary polls.
The provision bars a retiree from standing for a general election unless a period of three years has elapsed since the date of his/her resignation or retirement from service.
The HC on Monday discharged earlier issued rules that questioned the legality of the RPO clause 12(1)(f).
The HC bench of Justice Naima Haider and Justice Kazi Zinat Hoque delivered the verdict after hearing the rules issued separately by separate benches.
Earlier on November 29, the HC bench concluded its hearing on the rules and kept the matter for judgment.
Clause 12(1)(f) reads, "Provided that a person shall be disqualified for election as or for being, a member, if he has resigned or retired from the service of the Republic or of any statutory public authority or of the defense service, unless a period of three years has elapsed since the date of his resignation or retirement."
