Rule hearing on Fakhrul's bail deferred for a week

The High Court on Wednesday deferred for one week the hearing on its rule regarding granting bail to BNP Secretary-General Mirza Fakhrul Islam Alamgir in connection with a case filed over the attack on the residence of the Chief Justice (CJ) on October 28 last year.
The High Court bench of Justice Md Salim and Justice Shahed Nuruddin passed the order following a time prayer placed by a lawyer representing the petition filing lawyers of Mirza Fakhrul.
Addressing the lawyer, the HC then said, "You showed so much urgency then, why not now?"
On December 7, the HC bench refused to grant him bail, but issued a rule asking the state to explain in seven days as to why Fakhrul should not be granted bail in the case.
The state was asked to comply with the rule within one week.
Fakhrul's lawyers on December 17, 2023 prayed to the court to hold hearing on the rule.
Following their prayer, the HC bench fixed January 3 to hold hearing on the petition.
Accordingly, the petition came into the cause-list on Wednesday for hearing.
When the matter came for hearing, the representing lawyer said, "Pray for not this week, personal difficulties."
Pro-BNP lawyers have been carrying out a 'court boycott' programme since January 1 to express solidarity with the ongoing non-cooperation movement of BNP.
Fakhrul's lawyers, mostly pro-BNP, are also taking part in the boycott programme.
On December 3, Fakhrul filed the bail petition with the HC through his lawyers, saying that he was not involved in the vandalism of the Chief Justice's residence in any manner.
The case was filed with the Ramna Model Police Station on October 29 last year on charge of attack on the residence of the Chief Justice in Kakrail during a clash on October 28. The Detective Branch of police on the same day detained Fakhrul from his Gulshan residence around 9:25am.
On that day, Dhaka Metropolitan Magistrate Md Rashidul Alam sent him to jail, rejecting his bail prayer.
Later the petition was filed with the Metropolitan Sessions Judge's court. Judge (in charge) of Dhaka Metropolitan Sessions Judge's Court in Dhaka, Faisal Atiq Bin Quader, on November 22 rejected his bail petition in the case.
