SC clears way to continue proceedings to appoint candidates in non-cadre posts

The Supreme Court (SC) on Monday cleared the way for the Bangladesh Public Service Commission (PSC) to continue its proceedings to recruit qualified candidates in 4322 non-cadre posts from the 40th BCS examination.
The Appellate Division partly vacated its chamber judge's order that earlier issued a status quo upon the recruitment process of 4478 non-cadre posts which was supposed to be filled by 40th BCS candidates.
However, the apex court, upheld its chamber judge's status quo order only for 156 non-cadre posts of the Local Government Engineering Department (LGED).
A three-member bench of the Appellate Division headed by Chief Justice Hasan Foez Suiddique passed the order on Monday after hearing a petition filed by some candidates of the 40th BCS examination.
Lawyers Probir Neogi and Ragib Rouf Chowdhury appeared in the hearing on behalf of the candidates, while Attorney General AM Amin Uddin represented the state.
Following a petition filed by the LGED, the Chamber Judge of the Appellate Division issued a status quo on the total recruitment process.
Then 225 applicants who are aspirant to get recruitment at other departments out of the LGED filed a petition with the Appellate Division.

Hearing on that petition, the Appellate Court on Monday modified the status of the Chamber Court order and upheld the status quo on only 156 posts of the LGED. As a result, now there was no bar to continue the recruitment process in the remaining 4322 posts."
The PSC published the final results of the 40th BCS on March 30, 2022, recommending 1963 candidates for various cadre posts.
Other than this, the PSC also published the registration number of 8166 candidates, who passed the 40th BCS examinations, but couldn't get PSC's recommendation. So, the PSC called applications from these candidates to fill up the non-cadres posts at various government offices.
As many as 4,478 non-cadre vacant posts of ninth to 12th grades under various ministries and departments will be filled up from the 40th BCS.
