SC stays HC order of status quo over Solakia Imam

Wednesday, 16 September 2009

Backing a government plea, the Supreme Court (SC) Tuesday stayed Monday's High Court (HC) order having asked the DC of Kishoreganj to maintain status quo over the nomination of Imam for conducting Eid namaaj at Solakia Eidgah maidan, reports UNB.
The vacation chamber court of Justice SK Sinha passed the interim order following a petition moved by Attorney- General Mahbubey Alam as the government prefers leave to appeal against the HC orders, court sources said.
The day's SC order paved the way for newly-nominated Imams M Farid Uddin Masud and M Khalilur Rahman for conducting the traditional mammoth Solakia Eid congregation.
On Monday, the HC, upon a writ petition filed by removed Imam of Kishoreganj Solakia Eidgah Abul Khair M Saifullah, issued an order of status quo over the nomination of new Imam. Saifullah had been conducting the Solakia Eid namaj since January 2004.
The HC bench had also issued a rule upon the respondents, including the DC of Kishoreganj, to explain why the impugned nominations for M Farid Uddin Masud and M Khalilur Rahman made by the DC on September 2 as Imam for the Eid congregation, by axing the incumbent, "should not be declared illegal".
