SC to hear constituency delimitation writ on Sept 29

Tuesday, 23 September 2008

The hearing on a pending writ petition challenging the constitutional validity of the Election Commission's (EC) gazette notification finalising the re-demarcation of parliamentary constituencies ahead of the general election will be held on September 29, reports UNB.
A vacation division bench of the High Court (HC), comprising Justice Nazmun Ara Sultana and Justice M Rezaul Huq, fixed the date as Shahdeen Malik, a counsel for the EC, pressed for quick disposal of the writ petition.
The EC counsel's move was opposed by Barrister Nasir Uddin Ashim, the counsel for the writ petitioner, for hearing the rule during the vacation, but the court turned down the plea.
On August 7, the HC upon a writ petition filed by former state minister and ex-BNP MP (Dhaka-2) Abdul Mannan, stayed for three months the gazette notification of the EC finalising the delimitation of parliamentary constituencies.
The HC bench of Justice Khademul Islam Chowdhury and Justice Mashuque Hosain Ahmed had also issued a rule on the government and the EC to explain why the July 10 gazette notification should not be declared unconstitutional and void.
