SC upholds HC bail to Evaly's ex-MD Russel

The Appellate Division of the Supreme Court on Sunday upheld a High Court order granting bail to controversial e-commerce platform Evaly's former Managing Director Mohammad Russel in a case filed under the Digital Security Act by a customer.
Justice M Enayetur Rahim, chamber judge of the Appellate Division, passed 'no order' on a petition filed by the state seeking stay on the High Court order.
Earlier on June 6 this year, the High Court bench of Justice Mustafa Zaman Islam and Justice Md Aminul Islam granted bail to Mohammad Russel in the case. The state filed a petition against that HC order.
Lawyers Ahsanul Karim and Sayed Ahmed Raza appeared in the court hearing on behalf of Russel while Deputy Attorney General Sarwar Hossain Bappy represented the state.
Russel cannot be released from jail as he was shown arrested in some other cases, said his lawyer Ahsanul Karim.
Earlier on March 2 a Dhaka court framed charges against Evaly's chairperson Shamima Narsin and her husband Russel in the case.
Judge of the Dhaka Cyber Tribunal, AM Zulfiker Hayat, passed the order after hearing the charge sheet.
On September 30, 2021, Mohammad Alamgir Hussain, an Evaly customer, filed the case against the couple and 15-20 unidentified people with Badda Police Station.
According to the case statement, the complainant sent Tk 2.8 million through bKash and Nagad from January to September of 2020 for buying electronic goods from Evaly.
