Supreme Court judgment today on CG
Tuesday, 10 May 2011
The fate of the non-party caretaker government (CG) under the Constitution will be decided by the Appellate Division of the Supreme Court today (Tuesday). A 7-member bench of the Appellate Division headed by Chief Justice
ABM Khairul Haque will pronounce the judgment on a long pending
appeal against the impugned High Court ruling that declared valid the 13th amendment to the Constitution -- the non-party CG -- for holding general elections. In 2004, a larger High Court bench upon a Public Interest Litigation (PIL) writ petition declared valid the 13th amendment that provides for general elections under a non-party CG. The PIL writ petition was filed eleven years ago.
