HC asks Stitching BD Accord to leave country by Nov 30

The High Court (HC) issued a directive asking the 'Stitching Bangladesh Accord Foundation' to depart from Bangladesh by November 30, 2018.

The top court also asked the government to restrain itself from extending the tenure of the foundation in Bangladesh in any manner.

An HC bench comprising Justice Syed Refaat Ahmed and Justice Farid Ahmed came up with the directive in its final judgement on August 9 last.

Earlier, Mostafizur Rahman, chairman of Smart Jeans, a Chattogram-based apparel manufacturer, filed a writ petition against the foundation.

When contacted, Supreme Court (SC) lawyer Advocate Yousuf Ali told the FE that the HC issued the suo moto supplementary rule in this connection.

During the transition period from June 01 to November 30, 2018, the it will perform its functions of inspection and remediation subject to strict supervision and control of the Transition Monitoring Committee (TMC), Ali said citing the court order.

For any dispute or difference between the foundation and any individual supplier on any technical findings resulting in termination of the supplier would be finally decided by the TMC, he added.

The court also made the rule absolute and thereby declared the notification of reactivation of termination of Smart Group factories dated October 22, 2016 issued by the foundation to its signatory brands illegal and of no legal effect, the SC lawyer said.
