Dhaka metropolitan magistrate Rokanuddowla, who Sunday demanded a halt to the separation of the Judiciary from the Executive until 2021, has been removed from the Chief Metropolitan Magistrate's Court for Dhaka, and has been made officer on special duty (OSD) at the Establishment Ministry, report UNB and bdnews24.com.
Chief Justice Md Ruhul Amin Tuesday approved the removal of the controversial magistrate after the Establishment Ministry Monday sent a letter to the Supreme Court seeking approval to remove him from the magistracy.
Supreme Court Registrar Iktedar Ahmed acknowledged the approval by the Chief Justice.
Meanwhile, a contempt-of-court notice was served against Rokanuddowla and four others Tuesday for their remarks against separation of the judiciary from the executive control.
ZI Khan Panna, an advocate of the Supreme Court, asked Rokanuddowla and others to pray for unconditional apology within 24-hours through electronic and print media for their fierce remarks against the Judiciary separation.
The four others are - Bangladesh Civil Service (Administration) Association President M Moniruzzaman Khan and Secretary M Kamal Uddin Ahmed, Biman Bangladesh Airlines Managing Director Dr MA Momin, and Women and Children Affairs Ministry Project Director Dr Abul Hosain.
They were also asked them to file apology petitions to the Chief Justice. They will face contempt-of-court proceedings, if they fail to comply with the notice.
Besides, an official at the ministry said, Rokanuddowla, who had earned popularity for his anti-adulteration drive in the city, might even face charges of irregularities and treason.
At a seminar on 'Independence of the Judiciary for Good Governance', Rokanuddowla urged the executive officials to stop work from November 1, if the government did not clearly state that it would halt the separation process by that date.
He said, the postponement is necessary to remove the inequality between the executive magistrates and the judicial magistrates.
Bangladesh Civil Service (Administration) Association President President Abu Md Moniruzzaman Monday said, Rokanuddowla had violated the code of conduct for the administrative officials by making remarks against the separation of the Judiciary.
"The statement by Rokanuddowla is solely of his own, the association has no links with it," he said.
Moniruzzaman said, Sunday's seminar was organised to find ways to cooperate with the government about implementing the separation. Rokanuddowla's speech created chaos at the seminar. I tried to stop him, but he did not listen to me, he said.
"It seems to me that he was not mentally sound then," Moniruzzaman added.
