A full bench of the Appellate Division of the Supreme Court (SC) headed by Chief Justice M Ruhul Amin is likely to deliver the judgement today (Thursday) on the government prayer seeking a stay order on the High Court rules in which bail was granted to former Prime Minister and Awami League president Sheikh Hasina, reports UNB.
The HC order also stayed the proceedings of the extortion case filed against Hasina by Azam J Chowdhury, managing director of East Coast Trading (Pvt) Ltd.The Appellate Division Wednesday heard the arguments from Sheikh Hasina's chief counsel Barrister Rafiqul Huq and Attorney General Fida M Kamal. Opposing the stay, Barrister Huq said the extortion case against Hasina cannot be tagged to the amended provision of the Emergency Powers Rules (EPR). The case was brought under the EPR before submitting the charge sheet to the court by the investigating officer, he added.
Barrister Huq said the government's move seeking the stay is redundant as Sheikh Hasina has already been shown arrested in another case and more cases are in the queue. There is no scope for her to get out of her incarceration.
Meanwhile, bdnews24.com reports, a lawyer for detained Awami League chief Sheikh Hasina has asked the Anti-Corruption Commission if a deputy director can serve notice on a former prime minister to submit a wealth statement, a senior ACC official said Wednesday.
ACC secretary Mokhles Ur Rahman told reporters that the notice signed by Hasina's lawyer Barrister Fazle Nur Taposh had been couriered to the commission on July 31.
The legal notice claimed that only an ACC commissioner could send a notice to a former prime minister in line with ACC rules.
