SC stays HC bail to Hasina again

Backing the state plea, the Supreme Court (SC) Monday further stayed the High Court (HC) orders that granted bail to former Prime Minister Sheikh Hasina in two "extortion" cases, reports UNB.
A six-member full bench of the Appellate Division, chaired by Chief Justice M Ruhul Amin, passed the orders while disposing of the state's applications seeking leave to appeal to overturn the HC rulings.
The apex court in its orders also extended by one week the notice period for the detained former Prime Minister and Awami League chief to submit her statement of wealth to the Anti-Corruption Commission (ACC), as the ACC-set deadline expired on August 8.
"The stay would continue until disposal of the rules pending with the High Court," the court said.
Also, the SC gave a similar order staying operation of the HC-granted bail to business leader Abdul Awal Mintoo, who was arrested under the Emergency Powers Rules.
Following the apex court's orders, Hasina will remain in incarceration until the rules pending with the HC are resolved. The court orders clear the prosecution's path to go ahead with proceedings of the extortion cases filed against her.
Earlier, the HC, upon separate writ petitions filed by Hasina, had granted her interim bail in the two extortion cases and halted their trial proceedings.
It also had issued rule upon government to explain why enlisting the extortion cases under the stringent Emergency Power Rules (EPR) 'should not be declared without lawful authority'.
On another writ petition challenging the validity of the ACC notice, the HC, staying the operation of the notice, had issued rule upon the ACC to explain why its action 'should not be declared illegal'.
Meanwhile, the longstanding hearing of the application for quashing the Mig-29 purchase-scam case being faced by Hasina, and others continued Monday before a division bench of the HC.
