Amended EPR allows transfer of any case to Spl Judge's Court

The stringent Emergency Power Rules (EPR) 2007 has been amended empowering the government or the Anti-Corruption Commission (ACC) to transfer any scheduled criminal case under the EPR to the Special Judge's court from courts of Sessions Judge, Magistrate or Special Tribunal, reports UNB.
Under another new provision made regarding enforcement of the EPR, the government can introduce "any administrative measure by gazette notification in aid of inquiry into any offence, investigation, trial or other functions."
Earlier, after submission of any scheduled criminal case to the Magistrate's court, the police had to obtain sanction from the Home Ministry to place the case under the EPR.
Besides, the amended emergency rules relaxed a provision that denied bail to a detainee facing a corruption case.
The amendment says, "A co-accused in any case like wife, child under 18 years of age, unmarried daughter, mother, mother-in-law and sister of a principal accused is entitled to seek bail before the trial court."
