Council to make transparent appointments to constitutional posts, says Mainul

Adviser for Law and Information Barrister Mainul Hosein Sunday said, the Caretaker Government (CG) would form council to make appointments to the constitutional posts in a transparent and accountable manner, reports BSS.
Briefing newsmen at the conference room of Ministry of Law, Mainul said, the government was also working for creating an Attorney Service to help conduct cases and other related matters in favour of the government by appointing public prosecutors in a transparent and accountable way.
The proposed council, the adviser said, would recommend names of two persons for appointment to constitutional posts like judges in the Appellate Division and judges in the High Court, chief election commissioner, its commissioners, comptroller and auditors general, Public Service Commission chairman and its members and ombudsman.
The president will make the appointment for any constitutional post by choosing the person from the recommended list, he told the newsmen.
The draft proposals in this connection were discussed at the Council of Advisers' meeting, the adviser said adding, the Chief Justice of the Supreme Court will be the chief of the proposed council comprising nine other members.
Clarifying the necessity of formation of the Constitutional Council, Mainul said, a deadlock situation was created in the country in the past with the appointment of the chief election commissioner (CEC), as the appointments were made on political grounds.
The council will evaluate the academic qualification, professional skill, seniority, honesty and reputation of the competent persons, and if needed it will invite experts in the concerned field for making suggestions, the Law Adviser added.
Elaborating the justification of formation of the council and creation of Attorney Service, the adviser said, these were needed to make the judiciary free from politicisation and stop party politics among the lawyers.
Previously the public prosecutors were appointed by the political governments on political grounds, who were changed with the change of the government, Mainul said, adding that with the creation of the service it would be possible to make the appointment system permanent and the trainings for them would be arranged, and there would also be promotion.
