HC releases full verdict on quota reinstatement


The High Court (HC) has released the full verdict that declared illegal the government circular issued in 2018 abolishing the all quotas, including the freedom fighter one, in class one and two government jobs.
According to the 27-page HC verdict released on Sunday on the Supreme Court's website, the government can reform the quota system if necessary and if it wants.
The verdict reads that its transpires that the 30 per cent of quotas reserved for the children of freedom fighters had already been protected in a civil petition for leave to appeal.
Since, the Appellate Division has already settled the matter and affirmed the judgment and order of the High Court Division (regarding the issue) with the modification, the same is binding upon us as well as all authorities of the state machinery as per Article 111 and 112 of our Constitution and violation of the same is contemptuous, said the HC verdict.
"Considering these aspects of the matter and the observation as made above, we find merit in this Rule. Accordingly, the rule is made absolute with direction," it also reads.
It further reads that the circular issued on October 04 in 2018 abolishing all types of quota in class one and two government jobs is declared illegal.
In the full judgment, the HC directed the government to maintain all kinds of quota in all government jobs. However, it has also given an option to the government to reform or revise the quota system.
In the judgement, the HC said, "This judgement won't create any bar to the respondents if they change, reduce or increase the ratio or percentage of the quotas relating to the aforesaid criteria as and when necessary.
The respondents are at liberty to fill the vacant posts from the general merit list, if any quota is not fulfilled in any public examination."
The HC bench of Justice K M Kamrul Kader and Justice Khizir Hayat delivered the verdict after hearing a writ petition filed in this regard.
The short announcement of the verdict was delivered on June 5 this year and the full verdict has been published on Sunday.
Meanwhile, the Appellate Division of the Supreme Court on July 10 directed the parties concerned to maintain status quo for four weeks in respect of subject matter of the quota system in class one and two government jobs.
