Man sentenced to 15-yr in jail instead of real accused

ACC admits its fault

The Anti-Corruption Commission (ACC) has recently admitted its fault at the High Court over conviction of a person instead of a real accused in a graft case.

Advocate Khurshid Alam Khan, a counsel for the ACC, on Sunday last told the HC bench of Justice M Enayetur Rahim that they had made this mistake in good faith and they didn't have any mala fide intention.

The lawyer said the conviction of warrant was issued in the name of the wrong person as wrong address had been mentioned during the investigation and in the charge sheet.

Sources said a special judge of Noakhali sentenced one Kamrul Islam to 15 years in jail in a case filed on charge of forging SSC certificate during his admission to a college.

The Bureau of Anti-Corruption filed a case in 2003 against Kamrul Islam of 'West Rajarampur' of Maijdee upazila. The ACC submitted the charge sheet after 10 years in the case and he was sentenced to 15 years in jail after trial.

In the investigation report, the official concerned mentioned 'East Rajarampur' as the village address of the accused though the real name of the village is 'West Rajarampur'. The same mistake was made in the charge sheet.

After the conviction, the warrant was issued against one Kamrul Islam of 'East Rajarampur'. Real accused Kamrul's birth year is 1977 while another one's birth year is 1990. As per the ACC investigation, 'innocent' Kamrul passed SCC examination when he was 8 years old.

Later, 'innocent' Kamrul filed a writ petition with the High Court, seeking remedy. His petition came to the High Court's cause-list on last Sunday. On that day, the ACC submitted a written statement and admitted their fault. The High Court will deliver verdict on Thursday over the matter.
