A three-member Supreme Judicial Council headed by Chief Justice M Ruhul Amin is likely to sit any day for inquiry into an allegation of gross misconduct against two judges of the High Court, reports UNB.
A highly-placed source said the President desires that the Council inquire into the matter and report its findings.
The judges under scrutiny are Justice Zinat Ara and Justice Sheikh Abdul Awal, appointed during the immediate-past BNP-led coalition government's tenure, the source said.
On November 28 last year, Muhammad Ishaq, chairman and managing director of Elite Lamps Limited, seeking justice, submitted a written allegation to the President against the two judges on charges of abusing power and acting without their jurisdiction in connection with a civil appeal along with a contempt petition.
According to the source, the President has acted under Article 96(5)(b) of the Constitution. It says, "Where, upon any information received from the Council or from any other source, the President has reason to apprehend that a Judge may have been guilty of gross misconduct, the President may direct the Council to inquire into the matter and report its findings."
If the Council report goes against the judge concerned, the President shall, by order, remove the judge from office, the source said, quoting the provision.
