The National Board of Revenue (NBR) will continue collection of Value Added Tax (VAT) from patients as the judgment of the High Court is stayed by an interim order of the Appellate Division of the Supreme Court (SC).
VAT collection remained suspended for nearly 12 days after the HC issued an order on July 14 asking the NBR to stop collection of VAT on prescriptions of patients, pathological tests and diagnoses.
According to the existing law, patients have to pay VAT at the rate of 2.25 per cent on physicians' prescriptions or pathological tests. NBR receives Tk 25 million (2.5 crore) per day under this head.
A chamber judge court of the Appellate Division stayed the HC order
Tuesday until issuance of next order following a plea of NBR. Judge Mozammel Hossain issued the order.
Earlier the HC issued its order after lawyer Monjil Morshed filed a writ petition to stop VAT collection from patients. The HC also issued a rule against 16 pathological clinics to stop VAT collection.
Deputy Attorney General Mostofa Jaman Islam filed the appeal against the HC order in the chamber judge court.
