Court orders confiscating property of Evaly MD, chairman

A Dhaka court on Thursday ordered the authorities concerned to confiscate the properties of Evaly Managing Director Mohammad Russel and his wife, Evaly Chairman Shamima Nasrin, in connection with a fraudulent case.

Judge of the Metropolitan Magistrate Court in Dhaka Farah Diba Chanda passed the order after a petition was filed with the court in this regard, said Sakibul Islam, a lawyer for the complainant.

He said Evaly customer Muzahid Hasan Fahim filed the case with the same court on January 16 this year, bringing allegations of fraudulence and breach of trust.

That day, the court recorded statements of the complainants and summoned Russel and his wife to appear before it on February 15.

"On February 15, the Magistrate issued arrest warrants against the couple as they did not comply with the court's order that summoned them to appear before the court," he said.

"Today (Thursday) we filed an application before the court seeking a warrant of proclamation against the couple and attachment (confiscation of their properties). Upon hearing our petition, the court passed the order to confiscate their properties," said the lawyer.

According to the case documents, the complainant on February 20, 2021 paid Tk 0.29 million to Evaly for buying a motorbike, but the company did not deliver the bike within 45 days of ordering.

Instead, the company provided him a cheque which was later rejected by the bank, reads the case statement.
