The High Court (HC) Monday appointed a five-member amici curiae with senior jurists to give their legal opinions at the final hearing on a pending writ petition challenging the validity of the amended Criminal Procedure Code (CrPC) providing judicial power to executive magistrates, reports UNB.
Passing the order halfway through the hearing on the rule, an HC division bench, comprising Justice M Moinul Islam Chowdhury and Justice M Ashraful Kamal, fixed April 8 for the next hearing on the public interest litigation (PIL) writ petition filed by Human Rights and Peace for Bangladesh (HRPB).
The amici curiae (friend of the court) are Dr Kamal Hossain, barrister M Amir-Ul Islam, former Attorney General Mahmudul Islam, barrister Rokanuddin Mahmud and barrister Azmalul Hossain, QC.
On April 8, 2009, the government made the provision amending the CrPC.
According to the HRPB, the CrPC amendment ultra vires the 2007 landmark SC judgment on Mazder Hossain case over separation of the judiciary from the executive.
After a preliminary hearing on the PIL writ petition, the HC had issued a rule asking the government to explain why the impugned CrPC amendment providing judicial power to the executive magistrates should not be declared illegal.
