The High Court (HC) Wednesday issued a contempt of court rule against the education secretary, the chairman of Board of Intermediate and Secondary Education, Dhaka, and four others for not complying with one of its judgments on HSC script re-examination.
A bench of HC, comprising Justice Quazi Reza-Ul Hoque and Justice A B M Altaf Hossain, passed the rule in response to a contempt of court petition.
Other four respondents are: the secretary and the controller of examination of the board, and their lawyers - Advocate Tawfique Nawaz, husband of former foreign minister Dipu Moni, and Advocate S M Munir.
The court also summoned the education board's chairman and controller of examination and the lawyers to appear before it on May 19 to explain the issue.
They were summoned for not complying with the HC judgment and making 'contemptuous' remarks about its enforceability, a lawyer concerned told the FE.
In the rule, HC wanted to know as to why contempt of court proceedings should not be initiated against them.
On January 29, 2014, HC in a judgment directed the education board chairman and its examination controller to take measures to re-examine the answer script of chemistry examination of Farah Tasnim Raisa, a 2013 HSC examinee of Dhaka City College.
However, the authorities concerned did not comply with the directives even after Raisa's application to re-examine her answer script in line with the HC judgment, the lawyer said.
Rather, in a reply to Ms Raisa, the board, in line with its lawyers' counsel, termed the HC judgment "misconceived, ineffectual, redundant and unenforceable", he said.
Later, the student filed a contempt of court petition, upon which HC issued the rule and summoned them.
