The High Court issued on Thursday a rule upon the respondents to explain in two weeks as to why the Article 11 of the directions promulgated by the Department of Primary Education dated December 20, 2018, saying a PEC examinee could be expelled for unfair means in the examination, should not be declared illegal.
The court also wanted in the rule as to why the expulsion of the 15 examinees of the PEC (primary education certificate) till November 19 should not be declared illegal and as to why the respondents should not be directed to take reexamination of those expelled examinees.
Primary and Mass Education Secretary, Director General of Primary Education Department, Director General of National Primary Education Department and Chairman of Madrasa Education Board have been made respondents in the rule.
The High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order as Suo Moto (voluntary move) after four High Court lawyers brought the matter to the court's attention.
The lawyers are advocates AM Jamiul Hoque, barrister Farhad Reza, advocate M Mahmudul Hasan and advocate Md Faizullah.
After the court order, advocate AM Jamiul Hoque said, "To expel a primary student from the PEC exam could create a mental pressure upon him and he/she could be traumatized. That is why we drew attention of the court about the matter and the court passed the order."
