Sadeeq Agro challenges legality of DNCC notification to remove farm


Sadeeq Agro has filed a writ petition with the High Court challenging the legality of the notification issued by the Dhaka North City Corporation (DNCC) to remove its cattle farm.
Touhidul Alam Zenith, Proprietor of Sadeeq Agro, filed the petition with the High Court recently. His lawyer Md Tazul Islam submitted the petition.
The petition may be placed with the High Court bench of Justice Naima Haider and Justice Kazi Zinat Hoque for hearing.
The petitioner prayed to the court to issue a rule upon the respondents seeking explanation as to why the notification issued on July 2 this year by the DNCC to remove the farm from the Area-5 of the DNCC should not be declared illegal.
It also sought a stay on the operation of the notification issued by the DNCC and a direction upon the parties to maintain status quo in respect of possession and position of the petitioner's cattle farm, Sadeeq Agro.
Through the notification, issued on July 2, Regional Executive Officer and also Executive Magistrate of Dhaka North City Corporation raised his concern about establishing cattle farm in Area-5 of the DNCC and requested to refrain from establishing cattle farm in that area.
It also asked the Sadeeq Agro authorities to remove illegal cattle farm from that area.
In reply Sadeeq Agro authorities on July 10 sent a representation to the respondents including the DNCC Executive Magistrate requesting them to withdraw or cancel the notification. However, until filing the writ petition the respondents didn't disposed of the representation.
According to the writ petition, the Executive Magistrate before issuance of the notification didn't issue any show cause notice upon the writ petitioner, and as a result the petitioner didn't have any scope for explain him.
It further claimed that there is no objection from the Directorate of Environment regarding the cattle farm of the petitioner, but the Executive Magistrate without any legal basis issued the notification which is not tenable in the eye of law.
