The Appellate Division of the Supreme Court (SC) on Monday upheld a ban on setting up cattle markets at Aftabnagar in the capital on the occasion of Eid-ul-Azha, as it is a residential area.
The apex court dismissed a petition, seeking to vacate a High Court (HC) order that on May 8 stayed the notifications, issued by Dhaka North City Corporation (DNCC) and Dhaka South City Corporation (DSCC) for setting up cattle markets at Aftabnagar.
A four-member bench of the Appellate Division, headed by Justice Obaidul Hassan, passed the order after hearing the petition filed by the market's leaseholder.
On May 8, the HC stayed the notifications, issued by DNCC and DSCC for setting up cattle markets at Aftabnagar.
The court also issued a rule asking the government authorities concerned to explain as to why the notifications issued by the city corporations on April 4 for setting up cattle markets at Aftabnagar should not be declared illegal.
The bench of Justice Naima Haider and Justice Kazi Zinat Hoque passed the order after hearing a writ petition filed by Md Alamgir Hossain Dhali, president of Jahurul Islam City Society, and S M Kamal, its secretary, challenging legality of the city corporations' move.
Later, Nurul Islam, leaseholder of the cattle market, filed a petition with the Appellate Division, seeking to vacate the HC order.
Lawyers Shah Monjurul Hoque and Motahar Hossain Saju appeared in the court hearing on behalf of the writ petitioners, while Barrister Ajmalul Hossain represented the leaseholder.
