The Supreme Court (SC) turned down Sunday government plea for staying the High Court (HC) bail granted to former Federation of Bangladesh Chambers of Commerce and Industry (FBCCI) president Abdul Awal Mintoo, confined under the Emergency Powers Rules since May 30, reports UNB.
Chamber Judge M Hassan Ameen, after a brief hearing of government petition, referred the matter for hearing before a regular Bench of the Appellate Division tomorrow (Tuesday).
Additional Attorney General Salahuddin Ahmed moved the petition, as the government preferred leave-to-appeal against the High Court orders.
On August 7, the High Court, following a habeas-corpus petition filed by Mintoo's son Tabith Awal challenging the confinement of his father under the Emergency Powers Rules, declared 'unlawful' the confinement and granted him bail.
It also stayed the operation of another pre-emptive detention order served to Mintoo under the Special Powers Act, issued a day before pronouncement of the judgment.
