HC stays gazette declaring Hyee as MP

The High Court has stayed the effectiveness of a gazette issued by the Election Commission declaring Jhenaidah-01 Awami League candidate Abdul Hyee as winner in the January 07 election.
On Thursday, the election bench of Justice AKM Asaduzzaman granted the stay after hearing a petition filed by independent candidate Nazrul Islam Dulal.
The defeated candidate accused the winner of rigging and manipulation of results in the election.
Lawyers Shah Monjurul Hoque and Mohammad Mujibur Rahman appeared in the High Court (HC) hearing on behalf of Mr Dulal.
Mr Hoque said, "According to section 49 of the Representation of the People Order 1972, the defeated candidate filed the petition alleging rigging and manipulations of result in the election."
"Upon hearing the plea, the HC bench stayed for two months the gazette that declared the AL candidate Hyee as winner in the constituency."
The lawyer said the parliament membership of Mr Hayee would remain stayed for two months and he could no more participate in the ongoing sessions of the present parliament sessions following the stay order.
