Responding to plea from Khaleda Zia's lawyer for more time, the fifth High Court (HC) bench Tuesday shifted to May 18 the hearing on the petition against an executive order asking Gen Ziaur Rahman's widow to vacate the cantonment house, once the official residence of the army chief, reports bdnews24.com.
The bench of Justice Syed Rifat Ahmed and Justice Mainul Islam Chowdhury gave the decision when Khaleda's chief counsel TH Khan sought for time to file a supplementary petition.
"(Mrs) Khaleda Zia has been served a supplementary notice asking her to vacate the cantonment house. In this connection, a supplementary petition will be filed with the court," Khan told the court. "Hence the prayer for time until May 18."
The court then asked the government counsels if they would accept. "The government has nothing to object," said Additional Attorney General M Inayetur Rahim.
Murad Reza, another additional attorney general, also told the news agency that the government had no problem with the court giving Khaleda's counsels time until May 18. All three additional AGs including MK Rahman represented the government.
"Senior lawyer TH Khan will take part in the hearing on the writ petition. At the moment, he's busy with a case in the Appellate Division," Jamiruddin Sircar, another counsel of Khaleda Zia, had told the court Tuesday morning.
"Also, a supplementary petition will have to be prepared challenging the supplementary vacation notice. We need time to do that," Sircar argued.
BNP leader Salahuddin Quader Chowdhury and a number of pro-BNP lawyers were present in the court.
