Election Commissioner Shah Nawaz Tuesday observed that they are unable to take action against an elected member of parliament for hiding information in the affidavit, reports UNB.
Once the election is over, the EC has no legal authority to take action against an MP for hiding information in the affidavit, he told reporters at the EC secretariat.
"The Commission can take action only before the election, not later," he said when his attention was drawn to the allegation that Nizamuddin Hazari, an MP from Feni-2, hid information in his affidavit submitted to the EC before the January-5 parliamentary elections.
The EC has no legal jurisdiction to take action directly unless the Speaker requests for, he added.
The EC take action against false information in the affidavit only after receiving complaint as the commission usually does not have enough time to scrutinise the affidavits before the polls, Shah Nawaz said.
